Spin Mgmt CC LLC, Inc. (“Spin Mgmt”), a New York company with offices at 4140 Austin Blvd, Island Park, NY 11558, operates a communications platform for automotive dealerships (the “Platform”) which connects certain automotive dealerships (the “Dealership”) with members of the public. By using the Platform in any manner, including, but not limited to:
you (“You,” inclusive of any organization or party you act for) are agreeing to these terms of service (the “Terms”). The Terms form a legally binding agreement concerning Your use of the Platform and communications with the Dealership and Spin Mgmt CC LLC.
In operating the Platform, Spin Mgmt CC LLC is a service provider for the Dealership and all communications You have through the Platform are processed by Spin Mgmt CC LLC for the Dealership. In all communications between You and Spin Mgmt CC LLC, Spin Mgmt CC LLC is acting on behalf of the Dealership. Spin Mgmt CC LLC reserves the right to update these Terms at any time without notification. When You use the Platform, You are agreeing to the Terms as they are published at the time of that particular use.
You should know that:
1. Program Description: This messaging program sends appointment confirmation and reminder messages to customers who have booked an appointment with Spin Mgmt CC LLC through our website at spinmgmt.com, or via our scheduling forms, and have explicitly opted in to receive SMS notifications. Opt-in is collected via web forms with a dedicated checkbox for SMS consent. Messages include scheduling confirmations, appointment reminders, rescheduling updates, and customer support communications.
2. Cancellation Instructions: You can cancel the SMS service at any time. Simply text “STOP” to the same number that sent you messages. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
3. Support Information: If you experience issues with the messaging program, reply with the keyword “HELP” for more assistance, or reach out directly to john@spinmgmt.com or support@getcruisecontrol.com or call 866.983.7746 during business hours.
4. Carrier Liability: Carriers are not liable for delayed or undelivered messages.
5. Message & Data Rates: Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. For questions about your text plan or data plan, contact your wireless provider.
6. Supported Carriers: Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.
7. Age Restriction: You must be 18 years or older to participate in our SMS program.

We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines, regarding the use of SMS communications.
Spin Mgmt CC LLC does not manufacture, distribute, sell, repair, lease, or otherwise deal in vehicles. Spin Mgmt CC LLC operates the Platform to connect the Dealership with those looking to buy or service vehicles. If You make use of the Platform when shopping for or purchasing a vehicle, You are dealing and contracting directly with the Dealership. Spin Mgmt CC LLC is not a party to any agreement between You and the Dealership.
Spin Mgmt CC LLC may work with third parties, including lenders, credit agencies, and vehicle assessors (“Third-Party Partners”). Spin Mgmt CC LLC is not responsible for any information provided through the Platform by the Dealership or Third-Party Partners and does not guarantee accuracy, pricing, availability, or completeness of any information.
The Chat feature may utilize artificial intelligence and machine learning technologies. Responses are generated automatically and may be inaccurate, incomplete, or outdated. The Chat feature does not provide legal, financial, or professional advice. Do not share confidential or sensitive information. Inputs and outputs may be processed by third-party service providers and stored or processed in other jurisdictions, subject to our Privacy Policy.
You may only use the Platform to communicate with the Dealership and authorized Third-Party Partners. Spin Mgmt CC LLC reserves the right to suspend or terminate access at any time. Spin Mgmt CC LLC may store chat, SMS, and communication transcripts. You acknowledge that the Platform may contain third-party content and Spin Mgmt CC LLC is not responsible for the accuracy, legality, or appropriateness of such content.
You agree not to use the Platform to:
You agree to indemnify and hold harmless Spin Mgmt CC LLC and its affiliates from any claims arising out of Your use of the Platform or violation of these Terms.
You may opt-in to communications via chat, SMS, phone, or email. By providing Your contact information, You consent to receive communications from Spin Mgmt CC LLC and the Dealership, including automated messages. Consent is not a condition of purchase. To opt out of SMS communications, reply STOP or contact Spin Mgmt CC LLC at 866.983.7746, support@getcruisecontrol.com, or john@spinmgmt.com.
Users under 16 are not permitted to use the Platform. Users between 16 and 18 must have parental or guardian consent.
You must be 18 years or older to participate in our SMS program.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted.
The Platform and all associated content are owned by Spin Mgmt CC LLC or its licensors and are protected by intellectual property laws. These Terms grant You a limited, non-transferable right to use the Platform for personal, non-commercial purposes only.
By uploading content, You grant Spin Mgmt CC LLC a worldwide, royalty-free, perpetual license to use such content for Platform operation, improvement, and marketing. Feedback or submissions provided to Spin Mgmt CC LLC may be used without compensation. If You believe content infringes Your copyright, please submit a DMCA notice to support@getcruisecontrol.com.
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. Spin Mgmt CC LLC DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Spin Mgmt CC LLC’S TOTAL LIABILITY TO YOU SHALL NOT EXCEED $100.00. Spin Mgmt CC LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
All disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association. Arbitration shall be conducted on an individual basis only. No class actions are permitted.
These Terms constitute the entire agreement between You and Spin Mgmt CC LLC and are governed by the laws of the State of New York, without regard to conflict of law principles. If any provision is held invalid, the remaining provisions remain in effect.
